Throughout this Website, the terms "we", "us" and "our" refer to GoFLAVA. The term "you" or "service user" refers to the user of the Website. The term "Service" refers to our provision of the GoFLAVA website (www.goflava.com), including the sale of our products.

These Terms & Conditions ("Terms") apply to all users of the Website, including, without limitation, browsers, customers and contributors of content.

By visiting our Website and/or purchasing a product from us, you agree to be bound by these Terms, including any additional terms and policies referenced here (such as our Privacy Policy and our Shipping & Returns policy). Please read these Terms carefully before using the Website.

Any new features or tools added to the Website will also be subject to these Terms. We reserve the right to update, change or replace any part of these Terms by posting updates to this page. It is your responsibility to check this page periodically. Your continued use of the Website after changes are posted constitutes acceptance of those changes.

Our store is hosted on Wix.com Inc., which provides the online e-commerce platform that allows us to sell our products to you. Our orders are fulfilled by a trusted third-party partner; details relating to delivery and returns can be found on our Shipping & Returns page.

Nothing in these Terms affects your statutory rights as a consumer.

1. General conditions

We reserve the right to refuse service to anyone, for any lawful reason, at any time.

You understand that your content (excluding payment card information) may be transferred unencrypted and may involve transmissions over various networks and changes to conform to the technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, or access to the Service, without our express written permission.

The headings used in this agreement are for convenience only and do not limit or affect these Terms.

2. Online store terms

You may not use our products for any unlawful or unauthorised purpose, nor may you, in using the Service, breach any laws in your jurisdiction (including, but not limited to, copyright laws).

A breach or violation of any of these Terms may result in the immediate termination of your access to the Service.

3. Accuracy, completeness and timeliness of information

We are not responsible if information made available on this Website is not accurate, complete or current. The material on this Website is provided for general information only and should not be relied upon as the sole basis for making decisions. Any reliance on the material on this Website is at your own risk.

We reserve the right to modify the contents of this Website at any time, but we are under no obligation to update any information on the Website.

4. Prices and payment

All prices are shown in GBP (£) and are inclusive of VAT at the current rate, where applicable. Prices are correct at the time the information is entered onto the Website.

Where we charge separately for delivery or other relevant charges, these will be shown separately at checkout before you finalise your order.

Our prices are reviewed periodically, and all prices are subject to change without notice. Any change to the price of an item you have already ordered will be notified to you by email and will not be processed until confirmed by you.

We reserve the right to modify or discontinue any product or the Service (or any part of it) without notice at any time. We shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.

Payment Service Providers (PSPs):

All surcharges, where applicable, are non-negotiable.

5. Products

Most items we stock have lengthy Best Before End (BBE) dates of many months or years, but this may not always be the case. All mail-order products will have at least one month until their BBE date on the day of dispatch. Further provisions relating to short-dated goods are set out in our Shipping & Returns policy.

We have made every effort to display the colours and images of our products as accurately as possible. We cannot guarantee that your device's display of any colour will be accurate.

Certain products may be available exclusively online and in limited quantities, and are subject to return or exchange only in accordance with our Shipping & Returns policy.

Product ingredients, prices and descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.

We do not warrant that the quality of any products, services or information purchased or obtained by you will meet your expectations, except as required by law.

Allergen and dietary note: Our products are food items that may contain or come into contact with allergens. Please always read the product label and ingredients information carefully before consuming, and do not rely solely on the product descriptions on this Website if you have an allergy or specific dietary requirement.

6. Ordering from us

Before completing an order, our checkout process allows you to review your order and correct any errors. Once your order is completed, we will send you an order acknowledgement detailing the products you have ordered.

Our acceptance of your order, and the formation of a contract between us, takes place when we dispatch your order, not when you receive your acknowledgement. All products are checked for damage before dispatch; we do not knowingly dispatch damaged goods.

We reserve the right to cancel or refuse any order without giving a reason. Cancellations may occur if, for example:

  • the products are unavailable;

  • we are unable to obtain authorisation for your payment;

  • there has been a pricing or product description error; or

  • you do not meet any eligibility criteria set out in these Terms.

We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed under the same customer account, the same payment card, and/or orders that use the same billing or delivery address. If we change or cancel an order, we may attempt to notify you using the email address, billing address or telephone number provided at the time of the order.

Offers are at the discretion of our management and may be withdrawn without notice. Unless stated otherwise, offers cannot be used in conjunction with any other offer.

7. Delivery and returns

Information relating to delivery (including areas we deliver to, delivery times, costs and fulfilment) and to returns, cancellations, and defective, damaged or short-dated goods is set out in full on our Shipping & Returns page, which forms part of these Terms.

In summary, and without limiting that page:

  • We currently ship only to selected destinations within the UK mainland. Certain areas are excluded (including the Channel Islands, Isle of Man, Northern Ireland, Scilly Isles, and the Scottish Highlands and Islands); orders to excluded postcodes will be cancelled and refunded.

  • Orders are typically dispatched within 1–2 business days and delivered within 3–4 working days of dispatch, via Royal Mail or DHL.

  • You may cancel an order within 14 calendar days from the day after you receive your delivery, and then have a further 14 calendar days to return the goods. Goods must be returned unopened, undamaged and in their original packaging to qualify for a refund of the purchase price (less the original delivery cost).

  • A £5 return-to-sender fee may apply where a delivery is returned to us due to incorrect details provided by the customer or because it could not be safely delivered.

8. Accuracy of billing and account information

You agree to provide current, complete and accurate information for all purchases made through our store. You agree to promptly update your account and other information, including your contact and payment details, so that we can complete your transactions and contact you when needed.

9. Consumer rights

If you are a consumer, you have certain legal rights that cannot be excluded by these Terms, including under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. These include rights relating to goods that are of satisfactory quality, fit for purpose and as described, and your right to cancel certain online purchases. 10. Optional tools and third-party links

We may provide you with access to third-party tools that we neither monitor nor have any control over. You acknowledge that we provide access to such tools "as is" and "as available", without any warranties, and that we have no liability arising from your use of them. Any use of optional third-party tools is entirely at your own risk.

Certain content, products and services available through our Service may include materials from third parties, and the Website may contain links to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating their content, and we are not liable for any third-party materials, websites, products or services. Please review the relevant third party's policies before engaging in any transaction with them.

11. User comments, feedback and submissions

If you send us creative ideas, suggestions, proposals, reviews, recipes, photographs or other materials, whether online, by email or otherwise (together, "comments"), you agree that we may, at any time and without restriction, use, edit, copy, publish, distribute and otherwise exploit those comments in any media, without compensation to you. If you do not wish to grant us these rights, please do not send us your comments.

By submitting comments, you confirm that they are your own original work, do not infringe any third party's rights, are not defamatory or otherwise unlawful, and do not contain any malicious code. You agree to indemnify us against any losses we incur as a result of any breach of this section.

We are under no obligation to keep any comments confidential, to pay compensation for them, or to respond to them. We may (but are not obliged to) monitor, edit or remove any content that we consider, in our sole discretion, to be unlawful, offensive, defamatory or otherwise objectionable, or that violates these Terms. You are solely responsible for any comments you make and their accuracy.

12. Prohibited uses

In addition to other prohibitions set out in these Terms, you are prohibited from using the Website or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any local, national or international laws or regulations; (d) to infringe upon our or others' intellectual property rights; (e) to harass, abuse, insult, harm, defame, slander, intimidate or discriminate; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website.

We reserve the right to terminate your use of the Service for breaching any of the prohibited uses.

All content on this Website, including text, graphics, logos, images, product descriptions and the GoFLAVA name and branding, is owned by or licensed to MKAYG LTD and is protected by applicable intellectual property laws. You may not use, reproduce or distribute any of this content without our prior written permission.

14. Disclaimer of warranties and limitation of liability

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free, or that any results obtained from the use of the Service will be accurate or reliable.

To the fullest extent permitted by law, the Service and all products supplied to you are provided "as is" and "as available", without any representations, warranties or conditions of any kind, whether express or implied, except those expressly set out in these Terms or that cannot be excluded by law.

Liabilities we cannot exclude. Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of your statutory rights as a consumer (including under the Consumer Rights Act 2015); or (d) any other liability that cannot lawfully be excluded or limited. These carve-outs are required by law; without them, this section would be unenforceable.

Subject to the paragraph above, and to the fullest extent permitted by law:

  • you are responsible for reading product labelling, ingredient, allergen and dietary information before use, and we are not liable for any loss arising from your failure to do so or from your misuse of our products;

  • we are not liable for any loss or damage that was not reasonably foreseeable at the time you placed your order;

  • we are not liable for any indirect, special or consequential loss, nor for any loss of profit, loss of business, loss of contracts, business interruption or loss of goodwill;

  • we are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control (see Section 15); and

  • our total liability to you arising out of or in connection with any order, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the total price paid by you for the relevant products.

Our products are supplied for domestic and private use only. If you use our products for any commercial, business or resale purpose, we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

15. Events outside our control (force majeure)

We shall not be liable or responsible for any failure to perform, or delay in performing, any of our obligations that is caused by an event outside our reasonable control. This includes, without limitation: strikes or other industrial action; the failure, delay or default of suppliers, couriers or payment providers; postal or courier delays; internet, hosting or platform outages; acts of God; fire, flood or severe weather; epidemic or pandemic; and any act, restriction or requirement of any government or public authority.

Where such an event occurs, our obligations will be suspended for the duration of the event, and we will contact you to arrange a revised delivery or, where appropriate, a refund. We will not be liable for any delay or non-performance caused by such an event.

16. Indemnification

You agree to indemnify, defend and hold harmless MKAYG LTD and its officers, directors, employees, agents, suppliers and partners from and against any and all claims, demands, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising out of or connected with: (a) your breach of these Terms or any policy referenced in them; (b) your violation of any law or the rights of any third party; or (c) any content or comments you submit to us.

17. Entire agreement, waiver and third-party rights

These Terms, together with our Privacy Policy and our Shipping & Returns policy, constitute the entire agreement between you and us in relation to your use of the Website and your purchase of our products, and supersede any prior agreements, representations or understandings.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision, and no single or partial exercise of any right shall prevent any further exercise of it.

A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these Terms.

18. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

19. Governing law and jurisdiction

These Terms and any separate agreements through which we provide you with our Service shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have jurisdiction over any disputes, save that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your local courts.
